Terms & Conditions

1. Who you're contracting with

These Terms & Conditions (“Terms”) form a binding agreement between you and DJM Business Concepts (“the Company”, “we”, “us”), the operator of the Last Card website and related services (the “Service”), including the game at bigcardparty.com and the advertising service at /advertise.

2. Acceptance

By accessing or using the Service you agree to these Terms. If you do not agree, do not use the Service. If you use the Service on behalf of a business, you represent that you have authority to bind that business.

3. The Service

Last Card is a free, browser-based multiplayer card game. No account is required to play. Players may optionally purchase a text ad slot that rotates inside game rooms for 30 days.

4. Acceptable use

You agree not to:

  • use the Service in a way that is unlawful, fraudulent, or misleading;
  • send spam, malware, or attempt to probe, scan, or interfere with the Service's security or infrastructure;
  • scrape, resell, or redistribute the Service or its content;
  • submit ad content that is illegal, deceptive, infringes third-party rights, promotes hate, violence, adult content, or otherwise violates our published ad guidelines;
  • use display names or ad content that impersonate another person or brand.

5. Intellectual property

The Service, including its software, design, branding, and content (excluding user-submitted content), is owned by DJM Business Concepts and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable right to use the Service for its intended purpose. You retain ownership of ad content you submit; you grant us a non-exclusive, worldwide, royalty-free licence to host, display, and rotate that content solely to provide the advertising service.

6. Payments — Merchant of Record

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, tax, cancellation, and refund mechanics are governed by Paddle's Buyer Terms and our Refund Policy.

7. Ad review and removal

We may review, reject, edit, pause, or remove any ad at our discretion — including ads that are misleading, illegal, offensive, or violate these Terms. Refunds for removed ads are handled under our Refund Policy.

8. Suspension and termination

We may suspend or terminate your access to the Service (including active game rooms and ad listings) for material breach of these Terms, non-payment, a security or fraud risk, or repeated or serious policy violations.

9. Warranty disclaimer

The Service is provided “as is” and “as available”. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Service will be uninterrupted, timely, secure, or error-free.

10. Limitation of liability

To the fullest extent permitted by law, our aggregate liability arising out of or in connection with the Service is limited to the greater of (a) the fees you paid us in the 12 months preceding the claim, or (b) USD $100. We are not liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill. Nothing in these Terms limits liability that cannot lawfully be limited (for example fraud, death, or personal injury caused by negligence).

11. Indemnity

You agree to indemnify and hold harmless DJM Business Concepts from any claims or damages arising from ad content you submit, your unlawful use of the Service, or your breach of these Terms.

12. Changes

We may update these Terms from time to time. Material changes will be posted on this page with an updated “Last updated” date. Continued use of the Service after changes constitutes acceptance.

13. Governing law

These Terms are governed by the laws of the jurisdiction in which DJM Business Concepts is established, without regard to conflict-of-law principles. The courts of that jurisdiction have exclusive jurisdiction over any dispute, subject to mandatory consumer protections in your country of residence.
